1. Introduction

1.1. The sale of "Shingaar" branded products executed remotely through this site (hereinafter referred to as the "Website") is governed by the following General Terms and Conditions of Sale.

The products offered on the Website are sold directly by Shingaar Frédérique Goyal (hereinafter referred to as "Shingaar"). Shingaar is an individual company /sole proprietorship under Swiss law, with registered office at 79, chemin des Voirets,1212 Geneva Switzerland, tax code and VAT no. CHE-114.677.505 TVA, registered in the Business Registry of Canton Geneva on  19.01.2009  Ref 04842194/ CH 66001280099.

1.2. The use of the remote sale service governed by the General Terms and Conditions of Sale hereof is exclusively reserved to consumers (hereinafter referred to individually as "Customer" or, collectively, "Customers") meaning natural persons acting for purposes not related to the business, entrepreneurial, artisanal or professional activities possibly carried out, over the age of 18 (or, if younger, authorised by their legal representative).

The resale or transfer of the products purchased on the Website for any commercial or professional purpose whatsoever is expressly prohibited.

1.3. The General Terms and Conditions of Sale hereof are published on the Website for Customers’ information, storage and reproduction purposes, in compliance with the applicable laws currently into force.

1.4. The purchase of the products is exclusively governed by the General Terms and Conditions of Sale published on this website and into force at the time of the relevant purchase.

Shingaar reserves the right to amend and/or integrate the General Terms and Conditions of Sale hereof at any time.

Any amendments and/or integrations shall only be effective in respect of purchases made after the date the new version of the General Terms and Conditions of Sale is published.

The replacement of the General Terms and Conditions of Sale hereof with a new version automatically implies the non-applicability, ineffectiveness and non-enforceability of the former version with respect to purchases made after such previous version is removed from the Website, also in the event such General Terms and Conditions of Sale are in any way accessible and/or available to the general public through other internet websites other than the one indicated above.

2. Closing of contract

​

The presentation of goods on this website and the possibility to order the same shall not be interpreted as a binding offer on Shingaar's part. A binding offer to conclude a purchase contract shall not be made until the Customer places an order. Before finally submitting the order, the Customer may correct his order. An automatic confirmation of receipt will then be sent by email to the Customer. This confirmation shall not be deemed acceptance on Shingaar's part.  A purchase contract with Shingaar shall only be concluded when shiping the product to the Customer or confirming the order separately in a further email. The purchase contract may be concluded in English.

 

In the event of spelling, printing or arithmetic errors, Shingaar reserves the right to rescind the contract.

The actual colours of a product may deviate from the colours on the photos.

3.  Price and Payment

 

3.1. Prices are indicated in Swiss Francs, and include 7.7 %  Swiss VAT. 

The prices indicated do not include shipping costs. Those depend on the destination country. For shipping cost applicable, please refer to Shipping & Returns

 

3.2. Import/ customs duties may be accrue for deliveries outside of Switzerland. The amount of import/customs duties depends on local legislation and cannot be indicated. Import/customs duties are not included in the shipping cost and must be borne by the customer.

3.3. Products prices are subject to change without notice. Shingaar reserve its right, at any time, to modify or discontinue the service ( or any part or content thereof), and shall not liable to the Customer, or to any third-party, for any modification, price change, suspension, or discontinuance of the service.

3.4. Payment can be made by credit card, PayPal or by direct bank transfer.

4. Delivery

​

Deliveries shall be made to the deliver address specified by the Customer.

If delivery or another service is permanently impossible due to Force Majeure, a performance obligation on Shingaar's part shall be excluded. Any payment already received shall be refunded forthwith.

5. Disclaimer of Warranties

 

Shingaar does not guarantee, represents, nor warrants that the use of  its  sale services will be uninterrupted, timely, secure or error-free. The Customer expressly agrees that the service and the products delivered through this website are provided " as is" and " as available" for your use, without any representation, warranties, or conditions of any kind, either expressed or implied.

7. Limitation of Liability

​

Except in the event of willful misconduct or gross negligence, Shingaar shall in no way be liable vis a vis the Customer for any direct and indirect or consequential damages that may arise from the purchase of the Products offered for sale on the Website, or from the use of the Website.

 

 8. Governing law

​

The order and any litigation resulting from the order and from the order processing shall be governed by Swiss law. In case of dispute, the venue shall be Geneva , Switzerland.
